1. Overview
Acacia Avenue LLC ("Acacia," "we," "our," or "us") provides the Heads-Up Display software product ("HUD" or the "Software"), including HUD Personal (HUD-P) and HUD Enterprise (HUD-E) editions. This Privacy Policy describes what information the Software collects, how that information is used, and your rights with respect to that information.
This policy applies to all editions of the Software. Where practices differ by edition, those differences are called out explicitly.
2. Information We Collect
2a. HUD Personal (HUD-P)
HUD Personal does not collect, transmit, or send any information to Acacia or any third party. The Software operates entirely on your local device. The only data it stores is your display configuration (banner text and colors), which is saved locally on your device and never leaves it.
We do not collect:
- Personal identifiers (name, email, IP address)
- Device identifiers or hardware information
- Usage data or behavioral telemetry
- Crash reports or diagnostic data
- Location data
Future Releases: A future production release of HUD Personal may introduce telemetry to improve reliability. If and when that occurs, this policy will be updated and the nature of any collection will be clearly disclosed prior to or at the time of the update.
2b. HUD Enterprise (HUD-E)
The current release of HUD Enterprise does not collect, transmit, or send any information to Acacia or any third party. Like HUD Personal, it operates entirely on the devices on which it is installed. No telemetry, usage data, diagnostic information, or personal identifiers are transmitted to Acacia.
A future release of HUD Enterprise may introduce data collection to support licensing verification, usage telemetry, and reliability improvements. If and when that occurs, this policy will be updated in advance of any such change and will describe exactly what is collected, how it is used, and how long it is retained.
2c. Information You Provide
The Software does not include account registration, user profiles, or in-app forms. Any information you voluntarily provide to Acacia (e.g., via email inquiry or beta access request) is handled separately and is not governed by this policy.
2d. Third-Party Distribution Channels
The Software may be distributed through third-party channels including GitHub Releases and the Microsoft Windows Package Manager (Winget). Those platforms operate under their own privacy policies; Acacia does not control and is not responsible for their data practices. When you download HUD through any such channel, that platform may collect information such as your IP address and download metadata in accordance with its own terms of service.
3. How We Use Information
Currently, neither edition of the Software transmits any information to Acacia. In the event future releases introduce data collection as described in Section 2, any information collected will be used solely to verify licensing, identify and resolve reliability issues, and understand usage patterns to guide development. We will not sell personal information to third parties or use it for advertising.
4. How We Share Information
Acacia does not sell, rent, or trade your information. In the event data collection is introduced in a future release, we may share information only with service providers contractually required to protect it, or as required by law or valid legal process.
5. Data Retention
Neither edition currently transmits data to Acacia; accordingly, Acacia retains no information about users of the Software. Configuration data stored locally on your device persists until you uninstall the Software or manually delete it. In the event future releases introduce data collection, this section will be updated to specify applicable retention periods prior to any such collection beginning.
6. Data Security
Acacia employs commercially reasonable measures to protect any information it handles. Because the current Software transmits no data, the primary security responsibility lies with you — the operator of the devices on which the Software is installed.
7. Intended Users
The Software is designed for use by organizations, enterprises, government agencies, and their authorized personnel, as well as individual users on their personal devices. Use of the Software on behalf of an organization constitutes a representation that the user is an authorized representative of that organization.
8. U.S. Government Users
HUD Enterprise is designed for use by U.S. federal, state, and local government agencies. The Software and any related documentation are "commercial computer software" and "commercial computer software documentation" as those terms are used in 48 C.F.R. § 12.212 and 48 C.F.R. § 227.7202, as applicable. U.S. government end users acquire the Software with only those rights set forth in the applicable End User License Agreement.
9. International Users
The Software is developed and operated in the United States. If you are located outside the United States, please be aware that any information provided to Acacia may be transferred to, stored, and processed in the United States. International deployment of HUD Enterprise is subject to applicable local law, including data protection regulations of the relevant jurisdiction.
10. Your Rights
Because neither edition of the Software currently transmits personal information to Acacia, there is no personal data held by Acacia that pertains to individual users. If you have a question or concern, contact us at the address in Section 12.
11. Changes to This Policy
Acacia reserves the right to update this Privacy Policy at any time. Material changes — including any introduction of data collection not described in the current version of this policy — will be posted to this page with an updated effective date no less than thirty (30) days prior to taking effect. Your continued use of the Software following the effective date of any update constitutes acceptance of the revised policy.
